2. Service Agreement
2.1 Scope of Services
The Company agrees to provide comprehensive house clearance services tailored to the Client's specific needs. This includes, but is not limited to, the removal of household items, sorting of materials for recycling or donation, proper disposal of waste items, and cleaning up the cleared areas. Additional services can be discussed and agreed upon prior to commencement.
2.2 Service Fees
Fees for services are determined based on the volume and nature of items to be cleared, the complexity of the clearance, and the time required to complete the work. An initial estimate will be provided to the Client prior to the commencement of services. The final costs may vary depending on the actual work done, but the Client will be informed if there are any significant changes. Payment is due upon completion of the services unless alternative payment terms have been agreed upon in writing.
2.3 Payment Methods
The Company accepts various payment methods for the convenience of the Client, including bank transfers, credit/debit cards, and cash payments. Payment details will be provided to the Client before services commence. In cases where upfront deposits are required, these will be clearly specified at the time of booking.
3. Client Obligations
The Client must ensure that all items to be cleared are accessible and properly sorted in consultations with the Company’s representatives. The Client is responsible for securing any necessary permissions or permits required for the clearance process, especially in cases involving shared or communal properties. Additionally, the Client must inform the Company of any items that require special handling or disposal to ensure compliance with local regulations.
4. Company's Obligations
The Company commits to performing services professionally, efficiently, and in a timely manner. All employees and subcontractors are trained to handle items with care and respect for the Client's property. The Company will prioritize health and safety protocols during the clearance process to prevent accidents or damage. Furthermore, the Company ensures the ethical disposal of items, maximizing recycling and donation efforts to minimize environmental impact.
5. Scheduling and Cancellations
5.1 Booking Appointments
Clients can schedule appointments by contacting the Company through designated channels such as phone, email, or the official website. Upon booking, the Company will confirm the appointment details, including the date, time, and scope of services to be provided, ensuring that both parties have a clear understanding of the expectations.
5.2 Cancellations and Rescheduling
If the Client needs to cancel or reschedule an appointment, a minimum notice of 24 hours is required. Failure to provide advance notice may incur cancellation fees as outlined in the Service Fees section. In cases of emergency or unforeseen circumstances, the Company may waive cancellation fees at its discretion. The Company reserves the right to reschedule appointments due to unavoidable delays, such as inclement weather or equipment failure, in which case the Client will be promptly notified.
5.3 No-Shows
Clients who fail to appear for their scheduled appointments without providing prior notice may be considered as 'no-shows.' In such cases, the Company reserves the right to charge a no-show fee, equivalent to a percentage of the estimated service fee, to cover the costs incurred.
6. Liability
The Company is insured for public and employer’s liability, protecting both the Company and the Client against potential incidents. However, the Company is not liable for losses or damages arising from unforeseen circumstances, including but not limited to natural disasters, accidents beyond our control, or pre-existing conditions. The Client is responsible for securing personal and valuable items before the clearance begins, as the Company cannot be held accountable for misplaced or lost items after the service has been performed.
7. Privacy Policy
Client information collected during service booking is handled with the utmost confidentiality. Personal data will be used solely for the purpose of providing services and managing the Agreement. The Company adheres to relevant data protection laws, ensuring that all personal information is securely stored. The Company does not share Client information with third parties without explicit consent, except where required by law or for the performance of services. Clients have the right to request access to their personal data, as well as corrections or deletions, in accordance with data protection regulations.
8. Dispute Resolution
In the event of any dispute arising from the services provided, both parties agree to attempt resolution through direct negotiation and open communication. If a resolution cannot be reached through negotiation, the parties may seek mediation with an independent mediator agreed upon by both parties. Only if mediation fails to resolve the dispute will the parties consider legal action. All disputes will be handled in a professional and fair manner, aiming for a mutually acceptable outcome without unnecessary legal proceedings.
9. Amendments to Terms
The Company reserves the right to modify these Terms and Conditions at any time. Clients will be notified of significant changes via official communication channels such as email or phone prior to the changes taking effect. Continued use of services after such notifications constitutes acceptance of the updated terms. It is the Client's responsibility to review the Terms and Conditions periodically to stay informed of any modifications.
10. Governing Law
These Terms and Conditions are governed by and construed in accordance with the laws of the United Kingdom. Any legal actions related to these terms will be subject to the exclusive jurisdiction of the courts of the United Kingdom. This ensures that any legal matters are handled within the appropriate legal framework, providing clarity and consistency for both the Company and the Client.
11. Force Majeure
The Company shall not be liable for any failure or delay in providing services due to causes beyond its reasonable control. These include acts of God, wars, riots, terrorism, strikes, civil disturbances, pandemics, natural disasters, or any other unforeseeable events that prevent the Company from fulfilling its obligations. In such cases, the Company will make reasonable efforts to notify the Client and reschedule services once normal operations can resume.
12. Acceptance
By hiring House Clearance Euston, the Client acknowledges that they have read, understood, and agree to abide by these Terms and Conditions. This acceptance is a fundamental part of the Agreement, ensuring that both parties have clear expectations and obligations. If the Client does not agree with any part of these Terms and Conditions, they must refrain from using the Company’s services and seek alternative providers.
13. Additional Terms
13.1 Accessibility
The Company strives to make its services accessible to all clients. If the Client requires any special accommodations during the clearance process, they must inform the Company in advance to ensure appropriate arrangements can be made.
13.2 Hazardous Materials
The Company does not accept or dispose of hazardous materials, including chemicals, asbestos, or radioactive substances. Clients must inform the Company in advance if hazardous materials are present, to allow for proper handling and disposal by specialized professionals.
13.3 Confidentiality
Both parties agree to maintain confidentiality concerning all aspects of the Agreement and any proprietary information exchanged during the clearance process. This obligation continues even after the completion of services.
13.4 Severability
If any provision of these Terms and Conditions is found to be unenforceable or invalid under any applicable law, such provision will be limited or eliminated to the minimum extent necessary, so that these Terms and Conditions will otherwise remain in full force and effect.
13.5 Entire Agreement
These Terms and Conditions constitute the entire agreement between the Client and the Company regarding the subject matter hereof and supersede all prior and contemporaneous agreements, proposals, or communications, whether oral or written.
